The Diagnostic Brief: Terms and Conditions of Service

NOTICE: These Terms and Conditions of Use are legally binding and govern your purchase of The Diagnostic Brief from Sette (thesette.co). By completing your purchase, you accept and are bound by these terms. It is your responsibility to read these Terms and Conditions of Service carefully prior to purchase, use or access of any of our products and services.

Terms of this Course/Product/Service Purchaser Agreement

All programs, products and services are owned and provided by Typenest LLC dba Sette Consulting (“Company” or “we” or “us” or “our”, or “Sette”, or “Sette Consulting”).

The term “You” or “Your” refers to any user or purchaser of said program(s), product(s) or service(s) (the “Offering”). These Terms and Conditions of Use govern and define how You are allowed to use and access Sette’s Offering.

We reserve the right to update and change these Terms and Conditions of Use at any time, and will update them accordingly with the ‘date last updated’ at the top of this page.

You are legally bound to these Terms and Conditions of Use whether or not you have read them. If You do not agree with any of our Terms and Conditions of Use, please email us at support@thesette.co and we will make reasonable efforts to remove your name, email and access to our Offering and website(s).

What You’re Purchasing

The Diagnostic Brief is a single, standalone written diagnostic read. After purchase, you will receive a short brief with four prompts. You respond in writing — approximately 400 to 700 words across all prompts — and submit it through the provided form.

Within 5–7 business days of receiving your completed submission, Vivian will deliver a written response: what she’s seeing in your situation, what she’d examine further, and one question back.

The Diagnostic Brief includes:

  • One written submission (at least four prompts)

  • One written diagnostic read in response

The Diagnostic Brief does not include a phone call, video session, follow-up correspondence, ongoing advisory, or implementation support. It is not a smaller version of The Examination. It is a separate, self-contained decision tool.

Pricing and Payment

Payment is collected in full at the time of purchase through Stripe, PayPal, Klarna or Squarespace Payment payment processor. The price listed at the time you place your order is the price you will be charged. All prices are subject to change without notice, but changes will not affect orders already placed.

Listed prices do not include taxes or charges for shipping and handling. You will have notice of all such taxes and charges by reviewing your merchandise total in your shopping cart and in your order confirmation e-mail. We are not responsible for pricing, typographical, or other errors in any offer by us and we reserve the right to cancel any orders arising from such errors.

You represent and warrant that any payment information you provide is true, correct, and complete, and that you are authorized to use the payment method for this purchase.

Order Acceptance and Cancellation

Your purchase constitutes an offer to buy under these terms. Acceptance of your order and formation of the agreement between you and the Company takes place when you receive your order confirmation email. We reserve the right to decline any order at our sole discretion. If we decline your order, you will receive a full refund.

Your Submission

After purchase, you will have access to the submission form. Your written brief must be submitted within 30 calendar days of your purchase date.

The engagement includes one submission only. Once your brief has been submitted, it is considered final. Revisions, additions, or resubmissions are not included and will not be accepted. Please take the time you need before submitting.

If no submission is received within 30 calendar days, the engagement will be considered complete. No refund will be issued after the 30-day window closes. Refund requests must be made within 21 calendar days of purchase, as described in Section entitled “Refund Policy”.

If the situation shifts or you need additional time, you may contact us by email (hello@thesette.co) before the 30-day window closes to request a brief extension.

The quality of the diagnostic read depends on the honesty and specificity of your submission. We cannot be held responsible for the usefulness of the read if the submission omits material information about the situation.

Delivery

Your written diagnostic read will be delivered within 5–7 business days of receiving your completed submission. Delivery will be made by email to the address provided at purchase.

Delivery to the email address you provided at the time of purchase constitutes completed delivery. It is your responsibility to provide a valid, monitored email address and to check your spam or junk folder. If you believe you have not received the read, you must notify us within 7 calendar days of the expected delivery date.

The Diagnostic Brief is a one-way written deliverable. It does not include follow-up correspondence, clarifying questions, or ongoing discussion. If the read surfaces something you want to explore further, The Examination is the appropriate next step.

If circumstances require an extension, we will notify you directly and provide a revised delivery date.

Refund Policy

  • Within 21 days of purchase and before submission: You may request a full refund by emailing support@thesette.co, provided you have not yet submitted your written brief.

  • After 21 days of purchase: No refunds will be issued, regardless of whether the brief has been submitted. You will still have until the 30-day mark to submit your brief.

  • After submission: Once your brief has been submitted, the diagnostic process has begun. No refunds will be issued after submission, regardless of timing.

  • After delivery: The Diagnostic Brief is a professional service, not a physical product. Dissatisfaction with the diagnostic read’s conclusions is not grounds for a refund. The read reflects honest professional judgment, which may include perspectives that differ from your current framing of the situation.

  • If we are unable to deliver the diagnostic read for any reason, you will receive a full refund.

Confidentiality

Everything you share in your submission remains strictly confidential. We will not disclose any details of your situation, business, or identity to any third party without your explicit written consent.

If we wish to reference your engagement anonymously in future writing or case examples, written permission will be sought first. No identifying details will ever be used without consent.

Nature of the Service

The Diagnostic Brief is a professional diagnostic assessment based on Vivian’s judgment and experience. It is advisory in nature. It does not constitute legal, financial, therapeutic, medical, or any other form of licensed professional advice.

We cannot guarantee any specific business outcomes, financial gains, or results from the diagnostic read. The read is an honest assessment of the situation as you’ve described it. All decisions about how to act on it remain yours. You take full responsibility for your choices, actions, and results.

We warrant that the service will be performed in a professional and ethical manner, consistent with generally accepted standards in the field of diagnostic strategy. No other warranties, expressed or implied, including warranties of merchantability or fitness for a particular purpose, are made.

Intellectual Property

You may use the written read internally in your business — share it with a business partner, a leadership team member, or an advisor you’re working with. You may reference it in your own decision-making and planning. You may print or save it for your own records.

YOU MAY NOT resell, redistribute, or publish the written read in part or in whole. You may not reproduce, repackage, or present any portion of the read as your own work. You may not share it publicly or with anyone who has not purchased the Diagnostic Brief.

The diagnostic methodology, approach, and voice reflected in the read remain the intellectual property of Sette. All writings and materials you provided during the engagement remain your sole property.

Disclaimers

  1. EARNINGS DISCLAIMER. You agree that You understand individual outcomes will vary. Case studies or testimonials are not indicative of typical results. Each individual approaches our Offering(s) with different backgrounds, disposable income levels, motivation and other factors that are outside of Our control. Therefore, we cannot guarantee Your success merely upon access or purchase of our Offering(s) or related material(s).

  2. GENERAL DISCLAIMER. To the fullest extent permitted by law, we expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by you or others in connection with our Offering(s), including without limitation any liability for any accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of profits or contracts, anticipated savings, loss of data, loss of goodwill, wasted time and for any other loss or damage of any kind, however and whether caused by negligence, breach of contract, or otherwise, even if foreseeable. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.   4. TECHNOLOGY DISCLAIMER. We make reasonable efforts to provide You with modern, reliable technology, software and platforms from which to access our Offering(s) and related material(s). However, in the event of a technological failure, You accept and acknowledge our lack of responsibility for said failure, and while we will make reasonable efforts to support you, some technological issues are far outside our control and will require you to access support from a third party provider, such as ThriveCart Learn, Squarespace, Deftform, and Plutio.

  5. ERRORS AND OMISSIONS. We make no warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information in our Offering(s). We are not liable for any inaccuracies, errors or reliance on personal opinions contained in our Offering(s) or related material(s).

Limitation of Liability

Sette’s total liability in connection with the Diagnostic Brief shall not exceed the amount you paid for the service. Under no circumstances will Sette be liable for any indirect, incidental, special, or consequential damages — including lost profits, loss of business, or loss of goodwill — arising from the service or any actions taken based on the diagnostic read.

Neither party will be liable for breach-of-contract damages that are remote or speculative, or that could not reasonably have been foreseen at the time of purchase.

Indemnification

You agree to indemnify, defend, and hold harmless Sette, its owner, and any related parties from all claims, losses, expenses, fees (including reasonable attorney’s fees), costs, and judgments arising out of or related to your breach of these terms, your negligence, or your use of or reliance on the diagnostic read.

Financial Considerations

  • REFUNDS.

  • Within 21 days of purchase and before submission: You may request a full refund by emailing support@thesette.co, provided you have not yet submitted your written brief.

  • After 21 days of purchase: No refunds will be issued, regardless of whether the brief has been submitted. You will still have until the 30-day mark to submit your brief.

  • After submission: Once your brief has been submitted, the diagnostic process has begun. No refunds will be issued after submission, regardless of timing.

  • After delivery: The Diagnostic Brief is a professional service, not a physical product. Dissatisfaction with the diagnostic read’s conclusions is not grounds for a refund. The read reflects honest professional judgment, which may include perspectives that differ from your current framing of the situation.

  • If we are unable to deliver the diagnostic read for any reason, you will receive a full refund.

  • CHARGEBACKS. You agree to make every attempt to file a refund prior to attempting a chargeback with your financial institution. In the event of a chargeback attempt, You expressly agree to forfeit any and all of Our bonuses, affiliate bonuses or other materials afforded to you in exchange for your original purchase of our Offering. We reserve the right to present proof of Your access and these Terms and Conditions of Use to the financial institution investigating the dispute.

  • RECURRING PAYMENTS. If you have signed up for a payment plan, You hereby authorize our continued access to your financial information stored by our third party financial processing company referenced in this Agreement until your payment plan is complete, as set forth in Your acceptance of the purchase terms upon checkout.

  • REVOCATION OF ACCESS. You have the unilateral right to terminate your use and access to any of Our Offering(s). Please send an email to support@thesette.co to initiate this process. Termination will not excuse you of further payment. Upon confirmation of your termination, any and all outstanding balances will become immediately due and payable. Any existing balance that remains after 14 days from the date of termination will be sent to a collections agency, and You agree to be responsible for any additional charges, fees or costs associated with such a collection effort, including but not limited to reasonable attorney’s fees and court costs.

Privacy

Sette collects only the information necessary to deliver the Diagnostic Brief: your name, email address, payment information (processed by Stripe, Squarespace Payment, Klarna, or PayPal payment processor — Sette does not store your payment details), and your written submission.

Dispute Resolution

If a dispute arises, both parties agree to first attempt resolution through good-faith communication via email. If the dispute cannot be resolved informally, the parties agree to submit to binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association, in the State of New York. Judgment upon the award rendered may be entered in a court of competent jurisdiction.

Any claim must be brought within one (1) year of the date of the act or omission at issue, or it is permanently forfeited.

Dispute Resolution

If You and our Company cannot find a resolution to a dispute or potential claim by means of good-faith negotiation, then You explicitly agree to make a reasonable attempt to resolve any such dispute through Alternative Dispute Resolution or Mediation before filing a civil cause of action.

Non-Disparagement

If you are found to be slandering, libeling or otherwise disparaging our Company, Offering(s) or related materials at our discretion, You will be immediately removed from the Offering(s) and any related communications. We reserve the right to file a civil claim of action against You for any such damaging actions You take that materially harm our Company.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Force Majeure

Neither party will be liable for any delay or failure in performance resulting from causes beyond reasonable control, including but not limited to natural disasters, pandemics, war, government actions, or equipment and transmission failures. The affected party will give prompt written notice and use commercially reasonable efforts to minimize the impact.

Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

Modification

Sette may modify these terms from time to time. Any modifications will be effective immediately upon posting. The date of the most recent revision will be noted at the top of this page. Your purchase of the Diagnostic Brief constitutes acceptance of the terms in effect at the time of purchase.

Entire Agreement

These terms constitute the entire agreement between you and Sette with respect to the Diagnostic Brief and supersede all prior understandings, agreements, or representations of any kind, whether oral or written.
